  • The Site’s registration forms require users to give us certain information, like name, business name, business contact information, address, e-mail, and phone number, professional designations, and professional credentials. Information from registration forms is used to set up and administer your account, ship your purchases, and provide you with information about our company. 
  • The Site uses order forms for users to request information, products, and services. We collect certain contact and financial information in order to process orders, ship products, maintain records, and provide information about our company.
  • Unique identifiers (like Customer ID and password) are collected from Site users to verify the user’s identity, and for use as account numbers in our record system.

California Residents.

This notice for California residents supplements the information contained above for the benefit of users who are residents of California. We do not sell your information, and we do not share information for cross-context behavioral advertising.

We collect information as described above, specifically information that is provided by you or automatically collected from you by the Site, which may be considered “personal information.”

You may have the right to request certain information about our collection and use of your information over the 12-month period preceding your request. Once we receive, confirm, and verify your request, we will disclose to you:

  • The categories of sources for the personal information we collected about you.
  • Our business purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we disclosed your personal information for a business purpose, the disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

You have the right opt out of the sale of your personal information or sharing of your personal information for cross-context behavioral advertising. We do not sell your personal information or share your personal information of California residents for cross-context behavioral advertising.

You may have the right to request that we delete any of your personal information that we collected from you. Once we receive, confirm, and verify your request, we will delete your personal information from our records. We will deny deletion requests if retaining the information is necessary for us or our service providers to complete the transactions for which we collected the information, comply with applicable laws or if otherwise excepted from deletion.

To exercise the access or deletion rights described above, please submit a request to us by either: (1) calling us at 800-654-4432; (2) emailing us at privacy@emersonecologics.com, or (3) writing to us at Privacy Officer, 1230 Elm St., Suite 301, Manchester, NH 03101. Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may only make a request twice within a 12-month period. The request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include your name, email, address, and phone number as previously provided by you to us and your account type (whether practitioner or patient). We cannot respond to your request or provide you with information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We endeavor to respond to your request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. The response we provide will explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information. We will not charge a fee to process or respond to your request unless it is excessive, repetitive, or unfounded; if we determine that your request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service providers to: 

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; and
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

You have the right to be free from discriminatory adverse treatment for exercising these rights. We will not discriminate against you for exercising any of your California consumer privacy rights.

Additionally, California law permits residents of California to request notice of how their information is shared with third parties for direct marketing purposes.
